Software is a valuable company asset that must be managed and used properly. Unauthorised use, also known as software piracy, is strictly prohibited. We have summarised some of the key common issues below in ‘Your Obligations’ and in ‘Prohibited Actions’; such lists are intended as examples and are not exhaustive.

Your Obligations: How to Stay Compliant with our License Conditions

By using Foundry's software, you are agreeing to our End User License Agreement (EULA), which you can find here. Here are some examples of what you must always do:

  • Keep Licenses Current: Only use a current and valid license. You cannot use an old, expired, or lapsed license to access a newer version of the software.
  • Use the Correct License: Ensure that you are using a commercial license for commercial, professional, or for-profit projects. Never use a free, trial, or non-commercial license (including an educational license) for commercial work.
  • Respect License Limits: The number of concurrent users must never exceed the number of licenses you have paid for.
  • Adhere to License Type: Follow the specific terms of your license type (e.g. Node Locked, Floating), including any geographical restrictions of the license. Do not use your license outside the permitted territory for that license. Do not share license keys or login details or use a single-user license on multiple computers at the same time.

Prohibited Actions: What Not to Do

Any of the following actions are examples of a breach of our EULA and are strictly prohibited:

  • Installing Cracked Copies: Never install or use unlicensed or 'cracked' versions of Foundry software, even for short-term projects or workload peaks. Foundry offers short-term rental licenses for these situations.
  • Tampering with the Software: Do not reverse engineer, decompile, or otherwise alter the software or its licensing mechanisms.
  • Misusing Third-Party Code: Do not use any third-party software, including open-source components, in a way that violates their respective license terms.
  • Buying Software from Unauthorised Vendors: Do not buy Foundry software from third parties who are not authorised Foundry resellers.
  • Unauthorised License Transfers: Do not transfer any licenses unless authorised by Foundry, in accordance with the Foundry License Transfer Policy (which you can find here).

The Risks of Non-Compliance

Using Foundry software without a license is a violation of our EULA and can result in severe consequences, including, but not limited to:

  • Legal Action and Financial Penalties: We reserve the right to take legal action, which may include fines and other penalties, and to audit your systems for compliance. For more details on our policies and data handling, please review our EULA and our Privacy Notice (which you can find here).
  • Security Vulnerabilities: Unlicensed software often comes from untrustworthy sources and can expose your systems to malware, viruses, and other security risks.
  • Loss of Support: Unauthorised use invalidates your access to our support team, bug fixes, updates, and maintenance programmes.
  • Reputational Damage: Using pirated software can severely damage your professional reputation with clients and industry partners.

The Benefits of Compliance

Maintaining up-to-date and authorised software licenses is crucial. It ensures you receive:

  • Full Support: Direct access to our support team and to our maintenance programmes, including bug fixes, updates, and beta versions.
  • Security: Protection from malware and other vulnerabilities, and confidence that the software you are using has not been tampered with by a third party, or has any unauthorised export capability.
  • Financial Control: The ability to budget strategically and predictably for your software needs.
  • Peace of Mind: No fear of a license audit, raid or legal exposure, and the confidence that you and your clients are using legitimate assets, operating on a legal, ethical, and secure foundation.
